1. Scope of Service

1.1 SmartPay London provides a convenience payment service to facilitate the payment of ULEZ (Ultra Low Emission Zone) and Congestion Charge fees on your behalf.

1.2 This service is provided solely as an intermediary solution to assist customers with completing payments to the appropriate authorities. SmartPay London is not affiliated with any regulatory body.

1.3 Our responsibility is limited to processing the payment using the details you provide.


2. Customer Responsibility

2.1 Accurate Information:

  • Customers are responsible for providing complete, accurate, and up-to-date information, including but not limited to:
    • Vehicle registration numbers (number plates)
    • Payment details
    • Date(s) and time(s) of travel within the ULEZ or Congestion Charge zone

2.2 Consequences of Inaccurate Information:

  • SmartPay London will not verify or correct any inaccuracies in the information provided.
  • If incorrect information prevents the successful payment of a charge, SmartPay London is not liable for any penalties, fines, or enforcement actions imposed as a result.

2.3 Submission of Forms:

It is your responsibility to ensure all details entered during the transaction are correct before submitting the payment request.

2.4 Notifications:

Customers will not receive notification from SmartPay London if payment cannot be processed due to incorrect or incomplete details provided by the customer.


3. Payment and Processing

3.1 Payment Confirmation:

  • Payments are deemed successful only when a confirmation receipt is issued by SmartPay London. A confirmation of the payment request being received does not validate the payment being made.
  • Any delays or failures in payment processing due to system errors, banking issues, or external authority systems are outside our control, and SmartPay London shall not be held liable.

3.2 Processing Time:

Payments are processed on the same business day for requests received by 22:00 UK Local Time. Requests received after this time may be processed on the next business day.

3.3 Refund Policy:

Payments made through SmartPay London are non-refundable.


4. Limitations of Liability

4.1 Liability Waiver:

SmartPay London accepts no responsibility for:

  • Penalties or fines incurred due to delays or errors in processing payments resulting from incorrect information provided by the customer.
  • Failures caused by technical issues, system downtime, or events outside of our reasonable control.
  • Misinterpretation or misuse of the SmartPay London service.

4.2 No Guarantee of Payment:

SmartPay London does not guarantee payment acceptance by the relevant authorities in cases of incorrect details or if the authority systems are unavailable.


5. Compliance with Regulations

5.1 Customers are responsible for ensuring compliance with all applicable ULEZ and Congestion Charge regulations.

5.2 Use of SmartPay London does not absolve the customer of legal responsibility for payment of charges, including penalties or fines for late or non-payment.


6. Privacy and Data Protection

6.1 SmartPay London processes personal data in accordance with its Privacy Policy.

6.2 By using this service, you consent to the collection, use, and storage of your information solely for the purposes of facilitating the requested payment(s).


7. Amendments to Terms

7.1 SmartPay London reserves the right to amend these Terms and Conditions at any time. Updates will be posted on our website, and continued use of the service constitutes acceptance of the revised terms.
